1. Acknowledgment of RisksThe Participant acknowledges that participation in boat tours involves inherent risks, dangers, and hazards. These risks include, but are not limited to: changing water and weather conditions, collisions with other vessels or objects, capsizing, slipping or falling on deck, equipment failure, injuries, contact with marine life, and potential delays in receiving emergency medical care. The Participant understands and accepts that these risks cannot be completely eliminated.

2. Assumption of RiskThe Participant voluntarily chooses to participate in the boat tour despite the known and unknown risks. The Participant assumes full responsibility for all risks of personal injury, illness, death, or property damage, even if such incidents are caused by the negligence of the Activity Provider, its captains, crew, or representatives.

3. Release of Liability and Waiver of ClaimsThe Participant hereby completely releases, discharges, and waives any and all claims against the Activity Provider and its owners, employees, captains, and representatives (collectively, the "Releasees") for any liability, claims, demands, or damages arising out of or related to their participation in the tour. This release includes claims based on the ordinary or gross negligence of the Releasees.

4. IndemnificationThe Participant agrees to indemnify, defend, and hold harmless the Releasees from any and all losses, liabilities, damages, or claims (including legal fees and claims made by third parties) that arise out of or are in any way connected to the Participant's involvement in the tour.

5. Medical Information and Emergency ConsentThe Participant confirms they are physically and mentally fit to participate in the tour and have no medical conditions that would limit their safe participation. The Participant understands that medical facilities and emergency care may be limited or delayed while on the water. In the event of an emergency, the Participant authorizes the Activity Provider to seek and consent to emergency medical treatment on their behalf and agrees to assume full financial responsibility for all associated medical costs.

6. MinorsIf the Participant is under the age of 18, a parent or legal guardian must sign this Agreement on their behalf. By signing, the parent or guardian agrees to all terms within this document and agrees to indemnify the Releasees from any claims arising from the minor's participation.

7. Photo and Video ReleaseThe Participant grants the Activity Provider the irrevocable right and permission to capture and use their photograph, video likeness, and voice in media, marketing materials, social media, and on the company website for promotional purposes without any compensation.

8. Governing Law and JurisdictionThis Agreement shall be governed by and construed in accordance with the laws of the State of Florida. Any legal action or proceeding arising out of or relating to this Agreement must be brought exclusively in the courts located in the State of Florida.

9. SeverabilityIf any provision or portion of this Agreement is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions of the Agreement shall remain in full force and effect.

10. Acknowledgment and AgreementThe Participant confirms that they have carefully read this entire Agreement, fully understand its terms, and understand that they are giving up substantial legal rights by signing it. The Participant signs this Agreement freely and voluntarily, and acknowledges that this document represents the complete and entire agreement between the parties.
