1. Booking and Reservations
- Availability: All tours are subject to availability.
- Confirmation: Booking is confirmed upon receipt of full payment or as otherwise specified during the booking process.
- Accuracy of Information: Accurate and complete information must be provided when making a reservation.
- Age Restrictions: Passengers under 18 must be accompanied by an adult, and some tours may have additional age restrictions.
- Booking Modifications: Changes may be allowed up to 1 Day before the tour, subject to availability and potential fees. Refer to the Cancellation Policy for details.
2. Payment
- Payment Due Date: Full payment is due at the time of booking.
- Currency: All payments are processed in [USD].
- Late Payments: Failure to pay on time may result in cancellation.
- Surcharges: Applicable surcharges are in addition to advertised rates.
- Fees and Taxes: All applicable fees and taxes are included unless stated otherwise.
3. Cancellations and Refunds
- Cancellation by Customer:
- Cancellations made 5 Days or more prior to the tour are eligible for a full refund.
- Cancellations made within 3 Days but at least 1 Day before departure may receive a partial refund.
- Cancellations made within 24 Hours of departure Are Not eligible for a refund.
- Cancellation due to Weather: Full refunds are issued if a tour is canceled due to unsafe weather.
- Cancellation by Company: Tours may be canceled or rescheduled due to unforeseen circumstances like severe weather or mechanical issues. In such cases, an alternative date or a full refund will be offered.
- Refund Processing: Refunds are typically processed within 3-5 Days to the original payment method.
4. Safety and Conduct
- Compliance with Instructions: All instructions from the crew for safety must be followed.
- Assumption of Risk: The inherent risks of boating activities are acknowledged and assumed, including those related to equipment, marine life, and entering/exiting the water.
- Physical Fitness: Confirmation is required that you are physically fit for the tour activities, and it is understood that Boat Tours Today is not responsible for issues arising from medical conditions.
- Behavior and Code of Conduct: Responsible behavior and respect for others are expected. Disruptive behavior, including excessive alcohol consumption (unless permitted), may result in removal from the tour without refund.
- Limited Medical Facilities: It is understood that the boat has limited medical facilities.
- No Rescue Guarantee: Safe rescues or first aid are not guaranteed.
- Parental Consent for Minors: It is agreed not to sue or hold harmless the Provider for claims stemming from the ordinary risks of the activities, on your behalf and for any child.
5. Limitation of Liability
- Disclaimer: Boat Tours Today is not liable for injury, death, property damage, or losses from participation, except for gross negligence or intentional misconduct.
- Waiver of Claims: Claims against Boat Tours Today and its affiliates for injury, damage, or death are waived.
- Indemnification: You agree to indemnify Boat Tours Today against third-party claims arising from tour participation.
6. Photography and Media
- Authorization for Use of Images: Authorization is granted for the use of your image in photos/videos taken during the tour for promotional purposes without compensation.
- Third-Party Use: Media may be used for personal, non-commercial purposes, but commercial use requires consent.
7. Governing Law and Dispute Resolution
- Governing Law: These Terms are governed by Florida law.
- Jurisdiction: Any litigation will be brought in Florida.
8. General
- Entire Agreement: These Terms constitute the complete agreement regarding your booking.
- Severability: If any provision is invalid, the others remain in effect.
- Amendments: These Terms may be updated at any time, and you are responsible for reviewing the current Terms before booking.
